Jakarta. The Attorney General’s Office has officially handed over the corruption case implicating former National Police chief nominee Comr. Gen. Budi Gunawa to the police’s criminal investigation unit, or Bareskrim.
The case transfer occurred amid widespread criticism and questions about police impartiality.
Attorney General H.M. Prasetyo confirmed on Tuesday the transfer had taken place following a pretrial ruling that found the Corruption Eradication Commission (KPK)’s naming of Budi as a graft suspect to be unwarranted.
“Pursuant to the ruling, the Attorney General’s Office has ceded the Budi Gunawan case to the National Police for proper processing,” Prasetyo said.
Johan Budi, an interim leader of the KPK, said the antigraft body would not intervene in the case anymore following the court’s ruling.
Miko Ginting, a researcher at the Center for Legal and Policy Studies (PSHK), slammed the AGO’s action because it would preclude proper investigation. Bareskrim is currently headed by Comr. Gen. Budi Waseso, who is said to be Budi’s closest colleague.
“The case transfer should never have happened. Think of the massive conflict of interest and how the AGO has mishandled the case so far,” Miko argued.
Miko urged the KPK’s current leadership to file an appeal to challenge the pretrial ruling and rejected the idea of naming Budi the next deputy chief of the National Police.
“President Joko Widodo must not appoint Budi as deputy chief of the National Police or any other official position because of the ongoing legal process. To install Budi in a public office would go against ethics,” Miko said.
