PSHK

Establishment of a socially responsible law or towards socially responsible lawmaking is the vision of the Indonesian Center for Law and Policy Studies or commonly referred to as PSHK. Founded in 1998, PSHK is a research and advocacy institution for legal reform, focusing on legislation and justice.

In the field of legislation, PSHK carries out three main activities, namely legislative monitoring, legislative assessment, and legislative drafting. Legislation monitoring is carried out by attending and providing notes throughout legislative meetings. PSHK researchers also collect legislative documents displayed in parliament.net and @pantauDPR’s Twitter account. Most documents can be downloaded by the public to encourage involvement and narrow information gaps relating to legislation between parliament and the public.

Legislative assessment is carried out with methods and standards that are continuously being developed, including the achievements of quantity, quality, and compliance within legislation procedures. The assessment is carried out at the end of each year and at the end of the parliamentary working period (5 years) and presented in various forms, such as books, infographics, and videos. Based on this experience, PSHK developed a module for the design of laws and regulations which also contains theories and tips for designing laws and regulations that are friendly to the public. To date, the module has become a reference in PSHK’s work in drafting legislative regulations, as well as providing various related training.

In the field of justice. PSHK is consistently involved in the reform agenda at the Indonesian Supreme Court. In 2002-2003, PSHK became part of the assistance team for the preparation of the Supreme Court Reform Blueprint. The move continued in 2005 when PSHK was involved in making the corruption court administrative guidelines. Furthermore, from 2011 to 2012, PSHK was involved in four reform agendas in the Supreme Court, namely the preparation of a standardized court report manual, judiciary website assessment, public service standards in the court, and corruption court administrative standards. Most recently, in 2015, PSHK also took part as a member of the working group (pokja) drafting the Supreme Court Regulation No. 2 of 2015 concerning the Small Claims Court Procedure.

In addition, there are also several PSHK studies with themes outside the field of legislation and justice. Some of them convinced that research on the Presidential Decree deviation in 1998, the responsibilities of the legal profession in 2000, the BRR Aceh blueprint in 2005, and the cultural legal framework of the Republic of Indonesia in 2008.

PSHK earlier works include research on Presidential Decree by former President Suharto in 1998, the study on the legal profession in Indonesia in 2000 and the legal framework for cultural policy in 2009.

In the last 5 years, PSHK continues to initiate regulatory reform through their work with the National Development Planning Agency (Badan Perencanaan Pembangunan Nasional/Bappenas) on their Background Study on Regulatory Reform on their Long Term Development Planning 2019-2023. PSHK also works together with the Corruption Eradication Commission (Komisi Pemberantasan Korupsi/KPK) on drafting the Guidelines on Money Laundering and Asset Recovery on Capital Market. In 2019, PSHK working together with Lubis Ganie Surowidjojo, hukumonline and Barunastra finishes The Legal Framework and Government Institutional Landscape of The Fisheries Sector in Indonesia, supported by The David and Lucille Packard Foundation.

In line with their research affairs, PSHK continuously develops new innovative approaches in legal reform efforts in Indonesia. PSHK co-founded the most complete legal information portal Hukumonline.com (www.hukumonline.com), produced videos about LAWmotion, manage the Daniel S. Lev Law Library (www.danlevlibrary.net), and was involved in the establishment of The Indonesia Jentera School of Law (www.jentera.ac.id).

Transparency and accountability are the most important aspects of implementing legal reform. Experience has proven that any reform effort will not produce results without adequate transparency and accountability.

In line with these principles, PSHK has the maximum commitment to carry out each of its activities in a transparent and accountable manner. Financial management in PSHK is carried out based on a strict internal Standard Operating Procedure based on Financial Accounting Standard Guidelines No. 45 (PSAK-45).

The Indonesian Law and Policy Study Foundation

The Indonesian Law and Policy Study Foundation The Indonesian Law and Policy Study Foundation (YSHK) was established on July 1, 1998. Founded by several academics, advocates and law students, YSHK intends to participate in encouraging various legal reform efforts in Indonesia after the 1998 reform.

YSHK began its work in 1998 by establishing the Indonesian Center for Law and Policy Studies (PSHK), which until now has carried out various research and advocacy activities that have contributed significantly to the improvement of law in Indonesia. With an average of 10 studies every year, PSHK has built a good reputation in joint research with various ministries, parliamentary institutions, and judicial institutions in Indonesia.

PSHK is also active in carrying out various legal advocacies with various civil society organizations, especially in the issues of law enforcement, anti-corruption, human rights, environmental sustainability, and alignments for marginalized communities. PSHK routinely and continuously build expertise and conduct legislative drafting training. Participants trained by PSHK include members of parliament, ministries, civil society organizations, journalists, and various companies. Until now, more than 1,000 alumni have been produced by this PSHK training.

In 2000, YSHK co-founded Hukumonline.com, a new innovation that continues to grow in its field providing legal information in Indonesia. Hukumonline.com has now become the leading legal portal in Indonesia with more than 4 million visitors every month and 130,000 registered members using its legal information services.

In 2006, YSHK established the Daniel S Lev Law Library. The name of the library is given as a tribute to the late. Prof. Daniel S Lev (1933-2006) was an important teacher, friend, and supporter of the YSHK organization. In the library, there is also a room named after Prof. Koesnadi Hardjasoemantri (1926-2007) who from the beginning also gave a lot of guidance to the YSHK organization. The Daniel S Lev law library now manages more than 15,000 collections and has become a public library that not only serves as a reference source, but also used by the public as a place to meet, discusses, express attitudes, and various other activities to encourage legal reform in Indonesia

With more than ten years of experience managing research institutions, legal libraries, and legal information media, YSHK decided to take the next innovative step in 2011 by establishing the Indonesian Jentera School of Law. STH Indonesia Jentera was founded on the belief that legal order in Indonesia must continue to be maintained and built to be a driving force in achieving a democratic, just and prosperous Indonesia. Therefore, quality legal education is very important to produce legal practitioners who have skills and high integrity in supporting law reform efforts in Indonesia.

PSHK

Pembentukan hukum yang bertanggung jawab sosial atau towards socially responsible lawmaking. Itulah visi dari Pusat Studi Hukum dan Kebijakan Indonesia atau biasa disebut dengan PSHK. Didirikan pada 1998, PSHK merupakan lembaga penelitian dan advokasi untuk reformasi hukum, khususnya terfokus pada legislasi dan peradilan.

Pada bidang legislasi, PSHK melakukan tiga kegiatan utama, yakni pemantauan legislasi (legislative monitoring), penilaian kinerja legislasi (legislative assessment), dan perancangan peraturan perundang-undangan (legislative drafting). Pemantauan legislasi dilakukan dengan hadir dan memberikan catatan dalam rapat-rapat pembentukan undang-undang. Peneliti PSHK juga mengumpulkan dokumen legislasi yang dapat ditampilkan dalam parlemen.net dan akun twitter @pantauDPR. Sebagian besar dokumen dapat pula diunduh oleh publik untuk mendorong keterlibatan dan mempersempit kesenjangan informasi terkait legislasi antara parlemen dan publik.

Penilaian kinerja legislasi (legislative assessment) dilakukan dengan metode dan standar yang terus dikembangkan, meliputi capaian kuantitas, kualitas, dan ketaatan terhadap prosedur legislasi. Penilaian itu dilakukan setiap akhir tahun dan akhir periode kerja parlemen (5 tahun) yang dipresentasikan dalam berbagai bentuk, seperti buku, infografis, dan video. Berdasarkan pengalamannya itu, PSHK mengembangkan modul perancangan peraturan perundang-undangan yang berisi teori-teori serta kiat perancangan peraturan perundang-undangan yang ramah terhadap publik. Hingga saat ini, modul itu telah menjadi acuan dalam kerja-kerja PSHK dalam merancang peraturan perundang-undangan (legislative drafting), juga memberikan berbagai pelatihan terkait.

Beralih ke bidang peradilan. PSHK secara konsisten terlibat dalam agenda reformasi di Mahkamah Agung RI. Pada 2002—2003, PSHK menjadi bagian dari tim asistensi penyusunan Cetak Biru Pembaruan Mahkamah Agung. Langkah itu berlanjut pada 2005 ketika PSHK terlibat dalam pembuatan panduan administrasi pengadilan korupsi. Selanjutnya, pada 2011 hingga 2012, PSHK setidaknya terlibat dalam empat agenda kegiatan reformasi di Mahkamah Agung, yakni penyusunan manual standardisasi laporan pengadilan, judiciary website assessment, standar pelayanan publik di pengadilan, dan standar administrasi pengadilan tipikor. Terbaru, pada 2015, PSHK juga ambil bagian sebagai anggota kelompok kerja (pokja) penyusunan Peraturan Mahkamah Agung Nomor 2 Tahun 2015 tentang Tata Cara Penyelesaian Gugatan Sederhana.

Selain itu, terdapat pula beberapa penelitian PSHK dengan tema di luar bidang legislasi dan peradilan. Beberapa di antaranya, yakin penelitian mengenai Keppres menyimpang pada 1998, tanggung jawab profesi hukum pada 2000, cetak biru BRR Aceh pada 2005, serta kerangka hukum kebudayaan RI pada 2008. Beririsan dengan urusan penelitian, PSHK secara terus-menerus mengembangkan pendekatan inovatif dalam upaya reformasi hukum di Indonesia. PSHK ikut mendirikan portal informasi hukum terlengkap Hukumonline.com (www.hukumonline.com), mempublikasikan jurnal hukum JENTERA, memproduksi video-video tentang hukum LAWmotion, mengelola Perpustakaan Hukum Daniel S. Lev (www.danlevlibrary.net), dan terlibat dalam Sekolah Tinggi Hukum Indonesia Jentera (www.jentera.ac.id).

TRANSPARANSI DAN AKUNTABILITAS

Transparansi dan akuntabilitas merupakan aspek yang paling penting dalam pelaksanaan pembaharuan hukum. Pengalaman telah membuktikan bahwa segala usaha pembaruan tidak akan membawa hasil tanpa diikuti adanya transparansi dan akuntabilitas yang memadai.

Sejalan dengan prinsip tersebut, PSHK memiliki komitmen semaksimal mungkin untuk melaksanakan setiap aktivitasnya secara transparan dan akuntabel. Pengelolaan keuangan di PSHK dilaksanakan berdasarkan Prosedur Operasional Standar internal yang ketat dengan berpedoman pada Pedoman Standar Akuntansi Keuangan No. 45 (PSAK-45).
